These General Terms and Conditions govern the sales and contractual relationships between customers and the entities authorized to distribute and sell products bearing the registered trademark “Mario Muscariello” in their respective markets. These conditions may vary depending on the seller involved, the applicable jurisdiction, and the destination market. Customers are advised to carefully read the specific conditions applied by each seller, which will be made available upon order confirmation or upon request.

This website is for promotional purposes only and does not serve as an e-commerce platform. No direct purchases can be made through this website. All product sales are carried out by third-party entities authorized to distribute and market products under the “Mario Muscariello” trademark.

Any inquiries, complaints, disputes, or liability related to product sales, defects, delivery delays, or other commercial matters must be addressed exclusively to the final seller who issued the invoice and received the payment.

Mr. Mario Muscariello, owner of the trademark, does not engage in direct sales and cannot be held liable for the commercial or operational management of sales. As a fashion designer, Mario Muscariello is involved in creative consulting, style development, and artistic direction, all of which are purely intellectual and immaterial activities. The use of the trademark is granted to professional resellers — listed or not listed in this document — through specific licensing or distribution agreements.

1. TRADEMARK AND INTELLECTUAL PROPERTY

The trademark “Mario Muscariello” is registered in the name of Mr. Mario Muscariello, born in Naples on June 2, 1973, in several countries around the world. He is the sole individual authorized to grant usage rights of the trademark to third parties.

Authorized distributors and sellers operate under licensing or distribution agreements but do not hold ownership of the trademark.

This website includes:

  • original proprietary images;

  • images from the public domain;

  • digitally generated images created using artificial intelligence tools.

All content on this site, including text, graphics, logos, trademarks, photographs, videos, and digitally generated content, is protected under national and international intellectual property and copyright laws (including, but not limited to: Italian Law No. 633/1941; EU Directive 2019/790; U.S. Digital Millennium Copyright Act – DMCA; and the Japanese Copyright Act).

2. PRIVACY AND DATA PROTECTION

This website may collect minimal personal data through contact forms and web analytics tools. No sensitive data is collected or stored. The only information retained is that which is necessary for invoicing or managing commercial contacts. Credit card data is never collected or stored, as all payments are processed via third-party platforms (e.g., Stripe, PayPal). 2.1 Age Requirement and Purchaser’s Responsibility

All purchases, where permitted, may only be made by individuals over the age of 18 who use a credit card or bank account registered in their own name.

For transactions conducted remotely where the buyer is not physically present, we cannot verify the true identity of the purchaser. Therefore, we disclaim any liability for internal family or corporate disputes arising from unauthorized use of payment methods.

 

We will cooperate with authorities upon request by providing all available transaction information. In the event that a minor provides false information and completes a purchase, we decline all responsibility and reserve the right to cancel the order.

3. SHIPPING AND RETURNS INFORMATION

As this website does not conduct direct sales, shipping, delivery, return, and warranty conditions are provided directly by the authorized sellers at the time of purchase. Customers are advised to request such information prior to confirming any order.

4. DISTRIBUTORS AND APPLICABLE JURISDICTION

4.1 United States of America, Central and South America

Scope: B2B distribution across the Americas (North, Central, and South America). B2C sales are conducted throughout the Americas, except for the State of Florida, where exclusive retail rights are granted to Artigiano Inc.
Applicable law: Florida state law, jurisdiction: Miami court, with compliance under the California Consumer Privacy Act (CCPA) for data collected from California residents.

For all sales outside the U.S., Mario Muscariello LLC ships under CPT (Carriage Paid To) terms, as defined by the Incoterms® issued by the International Chamber of Commerce. This means that the LLC covers transport costs to the agreed destination, but is not responsible for customs duties, local taxes, or any fiscal charges, which are entirely borne by the buyer.

Buyers are responsible for customs clearance and payment of any duties or taxes in the destination country. This applies notably to the following countries in Latin and Central America (non-exhaustive list): Argentina, Brazil, Chile, Colombia, Mexico, Peru, Uruguay, Paraguay, Ecuador, Venezuela, Dominican Republic, Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, Panama, Bolivia.

4.2 Europe and Asia (excluding Japan)

Scope:

  • Wholesale distribution (B2B) across Europe and Asia;

  • Retail distribution (B2C) in Europe and Asia (excluding Japan).
    Applicable law: Italian law, jurisdiction: Naples court (Italy). GDPR compliance applies to all data processing.

In the case of B2C transactions, all applicable taxes and duties in the buyer’s country will be charged when required.

For shipments outside the EU and to Asian countries (excluding Japan), M.I.L.S. 1964 S.r.l. ships under CPT (Carriage Paid To) terms. This means MILS pays for transportation to the agreed destination but is not responsible for customs, local taxes, or additional duties, which must be paid by the buyer.

This applies to Asian countries including: China, India, South Korea, Indonesia, Malaysia, Thailand, Vietnam, Philippines, Singapore, Taiwan, Hong Kong, Cambodia, Laos, Myanmar, Nepal, Sri Lanka, Bangladesh, Pakistan, Mongolia, Kazakhstan, Uzbekistan.

And to non-EU European countries: Switzerland, Norway, Iceland, Liechtenstein, United Kingdom, Albania, Serbia, Montenegro, Bosnia-Herzegovina, North Macedonia, Kosovo, Moldova, Ukraine, Belarus, Turkey, Armenia, Georgia.

4.3 Japan
Exclusive distributor: Interepre

Scope: exclusive distribution, including retail sales, within Japan.
Applicable law: Japanese law, jurisdiction: Tokyo court, including reference to the Japanese Civil Code and the Act on the Protection of Personal Information (APPI).

Interepre is solely responsible for the payment of customs duties, sales taxes, and any local levies. The original seller bears no responsibility for such obligations.

5. PAYMENTS

Payments may be made via the following methods, depending on the seller and sales channel:

  • International bank transfer;

  • Letter of credit (upon approval);

  • Credit card (via authorized payment processors).

All sales are accompanied by a proper invoice, whether wholesale (B2B) or retail (B2C).

Unless otherwise agreed in writing with the seller:

  • Sales by M.I.L.S. 1964 S.r.l. are processed in euros (EUR);

  • Sales by Mario Muscariello LLC are processed in U.S. dollars (USD);

  • Sales by Interepre are processed in Japanese yen (JPY).

6. APPLICABLE LAW AND COMPETENT JURISDICTION

The applicable law and jurisdiction shall be determined based on the distributor/seller concluding the sale, as outlined in Section 4 above.

7. UPDATES AND CHANGES

These Terms and Conditions may be updated or amended at any time without prior notice. Updated versions will be published on this website and will become effective upon publication.
